RELEASE, INDEMNITY, AND ACKNOWLEDGMENT

In consideration for being permitted to participate in the “Desert Open Studios” the weekend of January 23, 24, and 25, 2026 and held in the Coachella Valley, California, as well as any preview or other exhibitions affiliated with Desert Open Studios, I hereby waive, release and discharge any and all claims for damages, for personal injury, death or property damage which I may have, or which may hereafter accrue to me, my representatives, agents, assigns and heirs, against Chris Blades, Kim Manfredi, Bill Schinsky and Bernard Leibov, members of Desert Open Studios, a nonprofit association, and organizers of the 2026 tour (“Organizers”), as well as all the volunteers, representatives, and agents of Desert Open Studios (“Releasees”) as a result of my participation in the tour or exhibitions affiliated with the tour.

This release is intended to discharge the Organizers and Releasees and their successors and assigns from and against any and all liability arising out of or connected in any way with my participation in the Desert Open Studios, even though that liability may arise out of the negligence or carelessness on the part of the persons or entities mentioned above. I further understand that accidents, personal injuries, and damage to personal property can arise out of my participation in the Desert Open Studios. Nevertheless, I hereby agree to assume those risks and to release and to hold harmless all of the Organizers and Releasees, who (through negligence or carelessness) might otherwise be liable to me, my representatives, agents, assigns and heirs for damages. It is further understood and agreed that this release and assumption of risk is to be binding on me, my representatives, agents, assigns and heirs.

In addition, I agree to indemnify and hold harmless the Organizers and Releasees from and against all claims, damages, losses and expenses including attorneys’ fees arising out of my participation in the Desert Open Studios caused in whole or in part by my negligent act, except where caused by active negligence or willful misconduct by the Releasees.

I HAVE CAREFULLY READ THE ABOVE RELEASE, INDEMNITY, AND ACKNOWLEDGMENT AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS AND HAVE CHECKED THE BOX ON THE SUBMITTED FORM.
